Practice Profile

Before converting to the Bar, Dan was a solicitor with a general commercial litigation practice including the following:

  • contractual disputes;
  • warranty claims on share purchase agreements; (disputes relating to interpretation of warranties and disclosure letter)
  • other disputes on business asset sales;
  • shareholder disputes;partnership disputes (application for declaration as to ownership of partnership assets, dissolution proceedings, injunctive relief against partners);
    professional negligence (various claims against accountants);
  • commercial agency (acting for both principal and agent in respect of claims under Commercial Agents Regs).
  • applications to set aside petitions for bankruptcy;
  • director disqualification proceedings (application for permission to act as director)
  • applications to prevent presentation of petition against companies.

Dan was also involved in defending one of the largest fisheries prosecutions brought by DEFRA in the South West to date.

Whilst a trainee at Osborne Clarke he undertook seats in pensions, private equity, property litigation and commercial litigation.

Since converting to the Bar, his experience has expanded to include the following:

contractual disputes (recent advice and pleadings for multi-track breach of sale and purchase agreement on behalf of wholesaler);

  • professional negligence (solicitors);
  • personal injury;
  • business tenancies (interim rent reviews);
  • possession proceedings (forfeiture/breach of covenant);
  • licensing reviews (for the Co-Operative Group);
  • injunctive relief (freezing injunctions);
  • contentious probate;
  • co-ownership and trusts of land;
  • employment tribunal advocacy;
  • small claims (especially credit hire).

During 2008 he was seconded for a month to a Jersey law firm (Bedell Cristin) to assist, on behalf of the Plaintiffs, in the largest piece of litigation to come before the Royal Court of Jersey. The claims related to various Jersey Trusts which were worth at one stage USD$150 million. Claims for breach of trust were brought against, among others, JP Morgan Trust Company (Jersey) Limited and the Protector, Sheikh Abdulla Ali M Alhamrani.
