Family Law

Public Law proceedings – representing Local Authorities, Children’s Guardians, Family Members, and Official Solicitor, adoption and all proceedings under Children and Adoption Act 2002.

Cases of Note include:

DEVON COUNTY COUNCIL v.  S AND ANOTHER [1994] 1 FLR 355 (Family Division - Thorpe J) Proper construction of section 100 Children Act 1989

DEVON COUNTY COUNCIL v. B [1997] 1FLR 591 (Court of Appeal) County Court has no power to grant injunctions in care proceedings – this has been slightly modified by statute since.

RE W (ASSESSMENT OF CHILD) [1998] 2 FLR 130 (Court of Appeal) The Court has power to order a named social worker to carry out an assessment, but this practice is discouraged.

RE W (SECTION 34(2) ORDERS) [2000] 1FLR 502 (Court of Appeal) Proper construction of section 34 Children Act 1989 orders.

C (CHILD) v. PLYMOUTH CITY COUNCIL [2000] 1 FLR 875 (Court of Appeal) – Identifying local authority with responsibility under a care order.

RE W (REMOVAL INTO CARE) [2005] EWCA Civ 642 (Court of Appeal) It was essential that Human Rights Act challenges were issued at the earliest possible opportunity. Such challenges should be issued prior to the removal of the children and not as a reaction to removal.
